Terms and Conditions

1. It is understood that Jennifer Rogers/A Place in Time Photography is the exclusive photographer retained to provide the photographic services as requested in this contract.

2. No part of any order, including previews, will be delivered until the bill has been paid in full.

3. Jennifer Rogers/A Place in Time Photography reserves the right to use images created under this contract for display and/or self-promotion/advertising.

4. The client signing this contract has actual authority to agree to the use of the likeness of all persons included in the portrait in this manner and shall indemnify and defend Jennifer Rogers/A Place in Time Photography in the event of litigation arising out of such use. Negatives, digital files, and previews remain under exclusive copyright of Jennifer Rogers/A Place in Time Photography.

5. Upon oral or written agreement, Jennifer Rogers/A Place in Time Photography, shall reserve the time and date agreed upon. Unless Jennifer Rogers/A Place in Time Photography is able to recover fees for cancelled reservations, all sitting fees and deposits are non-refundable even if the portrait is rescheduled or cancelled for any reason other than inclement weather. For Architectural Design photos, a minimum $75 cancellation fee will be imposed if less than 24 hours notice is given.

6. If, in the opinion of the photographer, inclement weather, or other adverse conditions prevent the creation of a portrait meeting artistic standards of A Place In Time Photography, the photographer may elect to reschedule the portrait or use and alternate location. Architectural Design photography sessions will simply be rescheduled.

7. If the Photographer cannot perform this contract due to fire or other casualty, strike, act of God, or other cause beyond the control of the parties, or due to Photographer’s illness or emergency, then the Photographer shall return any deposit or sitting fee to the client, but shall have no further liability with respect to the contract. This limitation to liability shall also apply in the event that the photographic materials are damaged in processing, lost through camera or media malfunctions, lost in the mail or otherwise without fault of A Place In Time Photography. In the event that the Photographer, Jennifer Rogers, fails to perform for any other reason, A Place In Time Photography shall not be held liable for any amount in excess of the retail value of the Client’s order.

8. Client is aware that color dyes in photography may fade or discolor due to the inherent qualities of dyes, and Client releases Jennifer Rogers/A Place In Time Photography from any liability for any claims whatsoever based upon fading or discoloration due to such inherent qualities.

9. The charges in this contract are based upon A Place In Time Photography’s standard price list. The price list is adjusted periodically and any future orders shall be charged at the prices in effect when the order is placed.

10. NOTICE OF COPYRIGHT – It is illegal to copy or reproduce these photographs elsewhere without A Place In Time Photography’s permissions. Any permissions granted will be with the agreement that full credit will be given to each and every image reproduced and/or displayed to A Place In Time Photography. Violation of this Federal Law may be subject to fines and/or penalties as applicable.

11. This contract incorporates the entire understanding of the parties. Any modifications must be in writing and signed by both parties.
